1. Acceptance
By creating an account or using NoteWhispr (the "Service") you agree to these Terms. If you don't agree, please don't use the Service.
2. The Service
NoteWhispr provides an AI-powered note-taking workspace at www.notewhispr.com: recording, transcription, AI text tools (summaries, translations, flashcards, quizzes), a Knowledge Vault, and a Marketplace where users may list approved study materials for sale.
3. Your account
- You must be at least 13 (or 16 in the EU/UK) to create an account.
- You are responsible for your password and any activity under your account.
- One account per person. Don't share credentials.
- Notify us at hello@notewhispr.com if your account is compromised.
4. Free trial & paid plans
- New accounts get a 3-day free trial — no credit card required up front.
- After the trial, paid plans renew monthly until cancelled.
- Pricing is published on the Pricing section of the homepage. Currently: $9.99/mo Standard, $14.99/mo Seller Unlimited.
- You can cancel at any time from the Billing page. Cancellation takes effect at the end of the current billing period.
5. Acceptable use
You agree NOT to use NoteWhispr to:
- Upload content that infringes someone else's copyright, trademark, or privacy rights
- Record people without their knowledge or consent where required by law
- Store or transmit unlawful, harassing, or harmful content
- Reverse engineer, scrape, or abuse the Service
- Resell or redistribute Service access without permission
We may suspend or terminate accounts that violate these rules, with refund only where required by law.
6. Your content
You retain all rights to the notes, recordings, and files you create. By using the Service you grant NoteWhispr a limited licence to store and process your content solely to provide the Service to you (e.g., running it through Smart Tools or transcription).
If you list content on the Marketplace, you grant buyers a personal-use licence to download and read it.
7. Marketplace rules (sellers)
- You must own or have the right to sell everything you list.
- Listings are reviewed before going live. We may decline anything that violates these Terms.
- Sellers keep a published share of each sale; the rest covers Stripe fees and platform costs. Payouts run via Stripe.
- Buyers may request a refund within a reasonable window if a listing is materially misrepresented.
8. AI-generated output
AI-generated summaries, translations, and other outputs may contain errors. Use your judgement — don't rely on them for medical, legal, financial, or safety-critical decisions without independent verification.
9. Service availability
We aim for high availability but can't guarantee zero downtime. Scheduled maintenance and rare incidents may interrupt the Service. We're not liable for losses caused by short outages.
10. Termination
You may close your account at any time from the Account page. We may suspend or terminate accounts that breach these Terms. On termination, you can export your data for up to 30 days, after which it is permanently deleted.
11. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, NoteWhispr's total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim arose.
13. Changes to these Terms
We may update these Terms occasionally. Material changes will be announced via email at least 14 days before they take effect. Continued use after the effective date means you accept the new Terms.
14. Governing law
These Terms are governed by the laws of the user's primary residence to the extent required by local consumer protection rules, otherwise by the laws of the United States.
